1. Overview

This website is operated by AEMCY Paris, trading as AEMCY ("we", "us", "our"), registered at Gevers Deynootweg 57C 2586BG Den Haag, Chamber of Commerce (KvK) number 42184739, VAT number NL870087149B01.

By accessing our website or purchasing from us, you agree to be bound by these Terms & Conditions, including the policies referenced in them. These Terms apply to all users of the site, including browsers, customers and contributors. If you do not agree to these Terms, you may not access the website or use our services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products.

2. Conditions of use

By using this website, you confirm that you are at least the age of majority in your country of residence and that you are legally capable of entering into a binding agreement.

You may not use our products or services for any illegal or unauthorized purpose, nor violate any applicable laws. Any misuse of the website, including the transmission of malicious code, may result in immediate termination of access.

3. Products & availability

AEMCY offers two selections:

Designer Archives: rare and collectible designer pieces from past collections.

Curated Vintage: handpicked vintage and quality secondhand pieces.

Unless stated otherwise, all pieces are pre-owned and each one is unique, so availability is limited to the single piece listed. We reserve the right to withdraw a piece or to correct its description or price at any time before an order is placed.

We make every effort to display products accurately. However, we cannot guarantee that colours or textures displayed on your screen perfectly reflect the actual product.

4. Condition of our pieces

The condition of every piece is described using the AEMCY Condition Guide, together with the condition note and the photos on the product page. Together these form the description of the piece you are buying.

Because our pieces are vintage, archive or secondhand, signs of age and wear that match the stated grade and note are part of the piece and are not considered defects.

5. Authenticity

Every piece sold by AEMCY is checked by hand and guaranteed authentic. If a piece is shown not to be authentic, we will refund it in full, including shipping costs.

6. Pricing

Prices are shown in euros, including VAT where applicable, and excluding shipping costs, which are shown at checkout. Prices may change at any time, but changes never affect orders that have already been placed.

7. Offers

On pieces showing the offer option, you can propose a price. We may accept, decline or reply with a counter-offer. An offer that we have not answered expires after 48 hours.

When we accept an offer, you will receive a link to complete your purchase at the agreed price. This link is valid for 48 hours. The piece is not reserved until payment is completed, so it may be sold to another buyer in the meantime.

A purchase made through an accepted offer is a sale like any other, and the same shipping, return and withdrawal rights apply.

8. Customer accounts

You can create an account to place an offer, follow your orders and save pieces to your wishlist. Saving a piece to your wishlist does not reserve it. You are responsible for keeping access to your email account secure, as it is used to sign in.

9. Orders & billing accuracy

We reserve the right to refuse or cancel any order, including those that appear fraudulent or abusive. If we cancel an order that has been paid, we will refund it in full.

You agree to provide current, complete and accurate billing and shipping information and to update it promptly if necessary.

10. Returns & refunds

Returns and refunds are described in our Return & Refund Policy, which forms part of these Terms. If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving it, as explained in that policy.

11. Third-party tools & links

We may provide access to third-party tools or links over which we have no control. We are not responsible for the content, accuracy or practices of third-party websites. Your use of third-party services is at your own risk and subject to their terms.

12. User comments & submissions

If you submit content (ideas, feedback, suggestions, reviews), you grant AEMCY the right to use, reproduce and publish it without restriction or compensation. You agree that your submissions will not violate any third-party rights or applicable laws.

13. Personal data

Your submission of personal information is governed by our Privacy Policy.

14. Errors & inaccuracies

Occasionally, information on the site may contain errors or omissions relating to product descriptions, pricing or availability. We reserve the right to correct such errors and, where an order was placed on the basis of an obvious error, to cancel it and refund it in full.

15. Prohibited uses

You are prohibited from using the website or its content for unlawful purposes, to infringe intellectual property rights, to harass, abuse or discriminate, to transmit malicious software, or to collect personal data without consent. Violation of these rules may result in termination of access.

16. Legal guarantee & limitation of liability

Nothing in these Terms limits the rights you have as a consumer under mandatory law, including the legal guarantee that a piece matches its description.

The website itself is provided "as is" and "as available". To the maximum extent permitted by law, AEMCY is not liable for indirect, incidental or consequential damages arising from the use of the website.

17. Indemnification

You agree to indemnify and hold harmless AEMCY and its affiliates from any claim arising from your breach of these Terms or violation of applicable laws.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions remain in full force.

19. Termination

These Terms remain effective unless terminated by either party. We reserve the right to terminate access to the site at our discretion if these Terms are violated.

20. Entire agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and Condition Guide, constitute the entire agreement between you and AEMCY and supersede any prior agreements.

21. Governing law

These Terms are governed by the laws of THE NETHERLANDS. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.

22. Changes to the Terms

We may update these Terms at any time. The version published on the website on the day you place your order is the one that applies to that order.
